The traditional private bipolar model of civil procedure has been put under pressure in a world of mass production and even mass rights. As a result, the courts decide the same questions of fact or law in several proceedings. Finally, it examines various methods to avoid contradictions and argues for the introduction of a mandatory legal procedure for all persons wishing to raise claims or defences that raise common issues.
