The traditional private bipolar model of civil procedure has been put under pressure in a world of mass production and even mass rights. As a result, the courts decide the same questions of fact or law in several proceedings. Multiplicity causes waste and anger, carries the risk of conflicting outcomes, and raises concerns about the appropriateness of representation when a court sets a precedent that affects the rights of others who are not on trial. This article argues that the diversity and associated risk of inconsistency contrasts with legal processes that use theoretical analysis, including Rawls` tripartite classification of procedural justice concepts and doctrinal analysis of procedural rules and evidence. Finally, it examines various methods to avoid contradictions and argues for the introduction of a mandatory legal procedure for all persons wishing to raise claims or defences that raise common issues.
